Senate Bill 287 was introduced to address two segments of the Administrative regulatory development process.
Timeline Reform
The first area addressed is the lack of a formal legal review before proposed regulations are put out for public comment. Too often the text of regulations finally adopted does not read the same as the proposed regulations the public commented on. That is because the Attorney General's Office does not conduct their final review and make changes until after the public has commented. Those amended regulations do not always go back for public comment before they are sent to the Lt. Governor for final certification.
Senate Bill 287 would establish a legislative legal services review prior to the public comment period. By placing the review at this point in the process any major problems that might render the public comment period and expense mute can be caught and hopefully corrected through a cooperative effort with the AG's office.
Quality Control Reform
The second reform offered is a review for consistency, conformity and quality by our legislative legal team. It is not reasonable to expect our main line staff to have either the experience or the professional expertise to do a legal examination of proposed regulations. It makes much more sense to use our Legal Service Team who actually draft the legislation and follow it's evolution throughout the entire process do our quality control review. Senate Bill 287 resolves this challenge by placing the review process under the auspices of Legal Services.
High Quality Means Lower Costs
It is my belief that a better quality control review process will not only mean higher quality proposed regulations, but also more timely and less frequently challenged regulations. This reform will translate into savings to government, to the public, to the Attorney General, while creating a more stable and responsible regulatory scheme for businesses to deal with.
