The Governor signed June 17, 2004. SB 179 allows teachers to receive a name-based background check, for purposes of a teaching certificate, if their fingerprints are illegible or nonexistent. Conforms Alaska statute to federal law to avoid jeopardizing Alaska’s ability to get federal background checks on anyone in the state. It also gives the Department of Education the ability to grant an applicant a sixty-day extension on top of the three-month application period in the situation that their prints are backlogged and not processed in time.

An Act prescribing a definition of 'damages' that a landowner may claim for injury to or interference with the owner's use of property by a person entering upon the land under the state reservation of oil, gas, mineral, material, or related interests, addressing the determination of the form, amount, and security of the surety bond determined by the director of lands to secure the landowner payment for damages, directing preparation of notice to the landowner for subsurface activities on the land, and setting a limitation on actions against a landowner resulting from entry upon land under the state reservation of interests.

On May 11, the Senate unanimously passed House amendments made to SB 65. Authorizes the Department of Corrections to enter into agreements with Fairbanks North Star Borough, Matanuska-Susitna Borough, Bethel, and the Municipality of Anchorage for new or expanded correctional facilities; authorizes the Department of Corrections to enter into an agreement for correctional facility space and services in the City of Whittier with a third-party contractor; and authorizes issuance of certificates of participation for upgrade, expansion of replacement of jails in Dillingham and Kodiak. The bill requires a feasibility study to determine whether the state can provide these services for the same or less cost than a third-party operator, requires a competitive bid process, adherence to the state procurement procedures, and approval of the facility design by the Commissioner of Corrections prior to entering into an agreement. Further, the bill requires that all correctional officers, probation officers and parole officers be certified by the Alaska Police Standards Council.

A House and Senate Conference Committee approved a compromise budget package Monday evening (05/10/04) that increases K-12 education funding by $82 million, the largest single increase to education in the State's history, and provides for capital needs. Portions of the bill are contingent on a three-quarters vote of the Legislature to approve using money from the Constitutional Budget Reserve to make up possible shortfalls in the FY 04 and 05 operating budgets, and restore money to be transferred into the CBR at the end of the 2004 and 2005 fiscal years under a constitutional provision requiring that general fund sub-accounts be swept into the Budget Reserve at the end of each fiscal year.

An Act relating to concealed handguns; allowing persons whose applications have been rejected as unqualified or whose permits have been revoked or suspended to continue to carry concealed handguns in this state if the person has a permit from another jurisdiction; requiring the Department of Public Safety to enter into reciprocity agreements concerning the carrying of concealed handguns.

06-11-03 : Gov. Murkowski signed HB 177 into law. Sponsored by Rep. Bill Stolze (R-Chugiak/Mat-Su), HB 177 recognizes concealed weapon permit holders from other states as valid permit holders in Alaska. David Guttenberg (D-Fairbanks), HJR 22 calls our leaders to caution with regard to the Patriot Act and urges them to apply the Constitutional principles that are meant to "secure the blessings of liberty" and not to erode the public confidence in our government through abuses of power.
