An Act amending the Alaska Wage and Hour Act as it relates to the employment of a person acting in a supervisory capacity; providing definitions for persons employed in administrative, executive, and professional capacities, for persons working in the capacity of an outside salesman, and for persons working in the capacity of a salesman employed on a straight commission basis.

04-07-05 : Clarifies the definitions of ''executive capacity,'' ''administrative capacity,'' and ''professional capacity,'' as defined in Administrative Code when determining overtime wages under the Wage and Hour Act. Replaces the ''long test,'' or ''80/20'' test with more understandable definitions. Clarifies ''exempt'' and ''non-exempt'' work when determining payment of overtime. Adds ''computer systems analyst, computer programmer, software engineer or other similarly skilled workers'' to the list of exemptions from the Wage & Hour Act.Provides a definition for ''outside salesman.''

04-21-05 : Amends an existing state law (AS 08.66.015) by deleting the phrase ''current model'' and adds a definition for ''new vehicle'' that is generally consistent with the Alaska Department of Law definition. In 2004, the Alaska Legislature passed HB 272 which amended the Auto Dealers Act. That law sought to protect consumers from autos marketed as new when in fact they had been previously sold or had the odometers switched out which voided the manufacturers warranty. The Department of Law concluded that law would be more effective if modications are made to the law.

05-02-05 : Unanimously passed Senate 5/2. Sunsets the Board of Dispensing Opticians (BDO) and transfers authority for regulating opticians to the Division of Occupational Licensing in the Department of Commerce, Community and Economic Development. Continues licensing for dispensing opticians. Increases from 2 to 4 the number of apprenctices that can work under one licensed optician, optometrist, or medical doctor. Simplifies the process for opticians from other states to be licensed in Alaska. Transfers administration of the optician's apprenticeship program from the state to the Department of Labor. USDOL administers a number of apprenticeship programs.
