Sectional Analysis for House Bill 301
Section 1: Amends AS 36.05.010, Wage rates on public construction. The amendments make reference to the new subsection (b) found in section 2 of this bill.
Section 2: Adds new subsections (b and c) to AS 36.05.010, Wage Rates on Public Construction. Subsection (b) states that when an economic disaster has been declared by the Governor for a specific area of the state, a public construction project located in that area is not subject to prevailing wage rates. This subsection also allows parties to a public construction contract to renegotiate contracts if an economic declaration has been issued after the contract has been signed. Under subsection (c), the Department of Labor is given the responsibility of issuing a list of communities covered in the economic disaster declaration and determining whether the public construction is exempt from prevailing wage rates.
Section 3: Amends AS 36.05.040, Filing schedule of employees, wages paid, and other information. Conforming amendment that refers to the new subsection (b) found in Section 2 of this bill.
Section 4: Amends AS 36.05.070(a), Wage rates in specifications and contracts for public works. Conforming amendment that refers to the new subsection (b) found in Section 2 of this bill.
Section 5: Amends AS 36.05.070(c), Wage rates in specifications and contracts for public works. Conforming amendment that refers to the new subsection (b) found in Section 2 of this bill.
