06-13-03 : Gov. Murkowski signed HB 111 into law. Sponsored by the House Rules Committee on request of the Governor, HB 111 extends the life of the Regulatory Commission of Alaska (RCA) to June 30, 2007. The RCA must hold public hearings and issue proposed regulations no later than November 15, 2003. HB 111 adds to the RCA’s policy that it shall encourage competition in the telecommunications industry; however, the established carrier shall not be placed at a disadvantage. How competition will be regulated also depends on whether a service area that has more than one telecommunications carrier also truly has a competitive environment.

Sponsored by the House Rules Committee by request of the governor, HB 112 extends the time the Alaska Industrial and Development and Export Authority to issue bonds for development projects $10,000,000 or less in value without legislative approval. Currently AIDEA has until July 1, 2003. HB 112 extends that time until July 1, 2007. HB 112 also makes permanent the tax exemption for a non-exclusive right to use property owned by AIDEA. After a reconsideration vote, HB 112 moves to the Governor.

Paul Seaton (R-Homer) on recommendation by the Joint Legislative Salmon Industry Task Force, HB 118 allows commercial fishermen to hire their own tender or pool their resources on one boat to transport fish to market. Currently, transporting another person's fish is illegal unless you are a licensed processor or act as a contractor for a licensed processor. HB 118 will require the person transporting the fish to have a transporter permit in addition to the currently required fish ticket. This arrangement allows a fisherman to retain ownership of the fish while authorizing an associate or another vessel to transport and sell the fish.

HB 119 : Water/Sewer/Waste Grants To Utilities

An Act permitting grants to certain regulated public utilities for water quality enhancement projects and water supply and wastewater systems.

03-19-03 : House Bill 119 moved out of the House Labor and Commerce Committee on Wednesday. Sponsored by Rep. John Coghill (R-North Pole), HB 119 enables a privately owned water and wastewater utility to participate in the State's water and wastewater grant program if the Regulatory Commission of Alaska regulates the utility. Grants for solid waste processing, disposal or recovery systems remain available only to municipalities. When the grant process is utilized, the private utility will not be able to pass on the cost of improvements paid to the ratepayers. The Regulatory Commission of Alaska will not include the grant in the capital costs portion of the formula that sets the utility rate. HB 119 moves to the House Finance Committee.

Jim Holm, HB 124 conforms Alaska commercial driver law to federal standards to avoid the loss of between $20 million and $40 million. HB 124 requires certain commercial vehicles to approach with flashers and stop at all highway railroad crossings. The bill prohibits an employer of a commercial vehicle from knowingly allowing, authorizing, or encouraging the driver to violate any federal, state, or municipal code or regulation relating to highway railroad crossings. HB 124 also requires the court to disqualify a commercial motor vehicle driver for certain periods of time upon conviction of such violations.

Bruce Weyhrauch (R-Juneau), HB 130 requires any party that brings a case under Alaska's unfair trade practice statutes to pay 15%, or $40 million of any damage award, whichever is less, to the State of Alaska. This bill is based upon the legislature's 1997 tort reform statute that requires any person who receives an award of punitive damages to pay 50 percent of the award into the general fund of the state.

05-18-03 : The Alaska State Senate unanimously approved House Bill 135 by a vote of 18 to zero on Sunday. Sponsored by Rep. Peggy Wilson (R-Wrangell), HB 135 adds the Board of Marital and Family Therapy to the list of boards that may request the Division of Occupational Licensing to contract for substance abuse treatment under licensed therapists. HB 135 also gives the Board of Marital and Family Therapy authority to order a licensed marital and family therapist to submit to a reasonable physical or mental examination if the board has credible evidence sufficient to conclude that the therapist's physical or mental capacity to practice safely is at issue, allows for individual client contact to be used as hours toward licensing, requires the therapist to communicate to a potential victim or law enforcement officer if a threat of imminent serious physical harm to an identified victim has been made by a client, and imposes disciplinary sanctions with regard to therapist sexual misconduct. After a reconsideration vote, HB 135 will move to the Senate for reconsideration.

Funds generated will be deposited into a separate account of the general fund and may be used for wildlife management, research, education, and viewing programs. HB 163 also raises the big game tag fees for non-resident and non-resident alien hunters to harvest caribou, moose, goats, and sheep. These increases bring Alaska's fees in line with fees charged in a number of other Western states for these or similar species.

HB 191 first allows municipalities to retain their existing land use authorities to regulate private activity within their jurisdiction. Second, the bill authorizes the Department of Natural Resources (DNR), as the implementing agency, to adopt local ordinances as enforceable policies to be applied in consistency reviews of federal projects and Outer Continental Shelf (OCS) development. The DNR would consult with the local government when interpreting and applying the local ordinance as part of a consistency review. Third, the bill would specifically adopt certain existing coastal district policies for federal OCS development as state enforceable policies.

Tom Anderson (R-Anchorage), HB 194 creates a tax credit for contributions made by businesses to Alaskan regional development organizations. This legislation limits the tax credit to the first $10,000 contributed by a business to a regional development organization. The tax credit allowed under HB 194, when combined with credits allowed under various other tax credit provisions in statute, may not exceed the previously established limit of $150,000. This tax credit will sunset in 2005.
HB 194 moves to the Senate Finance Committee.
