SB 1001 increases the cigarette tax from the current rate of $1 per pack of 20 to $1.60 per pack on January 1, 2005, $1.80 per pack on July 1, 2006 and $2.00 per pack on July 1, 2007. This bill also imposes an additional tax of $.25 per pack on cigarette brands manufactured by companies that did not sign the tobacco Master Settlement Agreement. These increases are expected to generate an additional $33.8 million in tobacco tax revenues by Fiscal Year 2008. This bill directs the legislature to place 8.9% of annual cigarette tax revenues (approximately $4 million by FY 2008) in the tobacco use education and cessation fund to support programs aimed at reducing cigarette consumption. This bill also includes provisions to allow the state to seize property used in the sale or transport of cigarettes in the state in violation of the cigarette tax act.
