Sponsor Statement for HB 510 "An Act relating to the regulation of commercial motor vehicles to avoid loss or withholding of federal highway money, and to out-of-service orders concerning commercial motor vehicles; amending Rule 43.1, Alaska Rules of Administration; and providing for an effective date."
This legislation is merely an action to align regulations with the appropriate department. This legislation completes the consolidation of the truck size, weight, safety and permitting regulatory programs that was started with Executive Order 98 effective at the beginning of Fiscal Year 98, when the Commercial Vehicle Enforcement Division was transferred from the Department of Public Safety to the Department of Transportation. The authority to promulgate regulations for driver/vehicle safety requirements and hazardous materials transport currently resides in the Department of Public Safety instead of with the Commercial Vehicle Enforcement Division (that enforces these regulations). This legislation transfers that regulatory promulgation authority to the Department of Transportation and Public Facilities so it may keep the regulations up to date with federal requirements. Failure to update the regulations could result in denial of federal highway funds. The Department of Transportation requested this legislation. The trucking industry has testified in support of the bill. # # # Attachments:
