Sponsor Statement for HB 289 An Act relating to the effective date of a municipal manager plan that has been adopted and to the effective date of the repeal of a municipal manager plan.
House Bill 289, "An Act relating to the effective date of a municipal manager plan that has been adopted and to the effective date of the repeal of a municipal manager." would ensure that a change in a municipal government's form of administration will not affect an existing mayor nor confuse the voters while protecting their rights. Whenever a municipal government administration change occurs there is potential for confusion. Candidates for strong mayor may be elected to office only to find themselves serving as a ceremonial mayor under a manager plan of government. Candidates for mayor under a manager plan may find themselves elected strong mayor. Voters may be uncertain as to which office they are electing a candidate. HB 289 corrects this problem by: Amending Section 1. AS 29.20.480(a) to read: The manager plan takes effect on the day after the last day of the term of mayor in office on the date the plan is adopted by the governing body. Amending Section 2. AS 29.20.520 to read: The reorganization provisions take effect on the day after the last day of the term of mayor in office on the date the provisions are enacted. By amending Section 2. AS29.20.530 to provide for a special election for mayor when a repeal of a manager plan is enacted and more than a year remains on the current mayor's term. By amending Section 3. AS29.20 to add: a new section to article 6 to allow a special election for mayor when a manager plan takes effect or a manager plan is repealed and more than two years remain in the current mayor's term.
