Sectional Analysis for CS for HB 464 (EDU) An Act relating to statewide school district correspondence study programs.
Sections 1 and 3: Revises the statute (14.07.050) that delegates the authority to select textbooks to school districts by including statewide correspondence study programs in the language. A sentence clarifies intent that no restrictions be placed on the use of educational materials not purchased with state funds. Section 3 applies the same changes to the statute (14.08.111 (9)) that governs regional school boards. Section 2(a): This section is an addition to AS 14.07 to define powers related to correspondence study programs offered by school districts, charter schools or Alyeska Central School. Specifically, Part 1: establishes a 5-year certification period for statewide correspondence study programs; This requirement does not apply to a program that is "in crisis" or "deficient" as established in AS 14.03:123(a) (school accountability). Part 2: addresses the responsibility of program staff to monitor enrolled students. Specifically, a certified teacher is responsible for at least quarterly monitoring and assigning of grades. Reference to "appropriately trained staff" is to impart the intent that routine monitoring of student progress is at the discretion of the governing body. Exceptions are made for special education students, who may receive more frequent monitoring by a certified teacher. Section 2(b): aligns definition of "district" to existing state statute. Section 4: Revises the statute (14.14.090(7)) that requires districts, when selecting textbooks or curriculum materials, to check for violations of statutes that address gender bias or inclusion of religious or sectarian material.
