Committee to Review Code Interpretation
(JUNEAU) - The Administrative Regulation Review Committee (ARR) will hold its first meeting of the second session on Wednesday, Jan. 30 at 8:30 a.m. On the agenda will be a review of recently adopted mechanical contractor regulations by the Department of Community and Economic Development's Division of Occupational Licensing. "I called the meeting to find out if the regulations are even legal in their present form," said Rep. Lesil McGuire (R-Anchorage) chair of the committee. "Other members of the committee and I question whether you can interpret 'Uniform Mechanical Codes' as a generic term." Recently, the state Department of Public Safety's fire marshal adopted the "International Mechanical Code," as the departmental standard, which differs in several areas from the "Uniform Mechanical Code," being used by other departments. Public Safety acted within the requirements of statute. The problem, however, is that state occupational licensing statutes require the use of the "Uniform Mechanical Code," McGuire said. Both codes are copyrighted documents and independent of each other. The concern is that the Division of Occupational Licensing has adopted regulations that incorporate the International Code claiming that the "Uniform Mechanical Code" is a generic term. The meeting will be held in the House State Affairs Committee room in the State Capitol, Room 102. It will be teleconferenced to Anchorage and Fairbanks with other sites invited to join. # # # Attachments:
