(Juneau) - House Bill 318, legislation sponsored by Representative Lesil McGuire (R Anchorage), to limit the use of eminent domain in Alaska, has passed the Senate by a unanimous vote.
HB 318 limits the use of eminent domain by stating first, that a person's private property may not be taken and transferred to another private entity for economic development, and secondly, that part or all of one's primary residence may not be taken for recreational opportunities.
"Many Alaskans today can live with certainty that private property is safe from arbitrary eminent domain seizures. The Kelo decision sent shockwaves through Alaska. I responded by making it absolutely clear in Alaska state law that private property rights are paramount," said Representative McGuire.
HB 318 moves to the Governor to be signed into law.
