06-18-03 : Gov. Murkowski signed HB 216 into law. Sponsored by the House Labor and Commerce Committee, HB 216 clarifies that local governments have the right to tax any fuel consumed within their governmental boundaries, but do not have taxing authority for value added products refined for shipment and sale outside the local boundaries.

The Alaska House of Representatives unanimously approved House Bill 305 by a vote of 35 to zero on Friday. Sponsored by the House Labor and Commerce Committee, HB 305 phases in an 8.2% increase the maximum weekly unemployment benefit amount over a three-year period.

HB 311 : Employer Responsibility For Workers' Compensation

An Act requiring a subcontractor to obtain workers' compensation insurance covering the subcontractor and the subcontractor's employees and establishing responsibility of a contractor for obtaining workers' compensation coverage for the subcontractor and the subcontractor's employees if the subcontractor fails to obtain workers' compensation coverage; and providing for an effective date.

HB 389 : Deferred Deposit Advances (Payday Loans)

An Act relating to certain monetary advances in which the deposit or other negotiation of certain instruments to pay the advances is delayed until a later date; and providing for an effective date.

CS made a number of substantial changes:

· The bond shall remain effect for three years following the denial or expiration of a license. $500 cap (vs. $1,000 cap in original bill)
· Only 2 rollovers allowed (4 in original bill)
· Lender must post a bond to get a license (no bond in original bill)
· Lender will be subject to closer scrutiny by Division of Banking
· Lender must offer consumer a payment plan option before initiating legal action to collect against a consumer in default, including sending a certified letter offering to assist consumer.
· There is a $700 cap on total damages lender can recover (in addition to face value of checKB] for collection efforts ($1,000 in original bill).
· Lender can only charge $15 per $100 loaned and NO OTHER FEES, CHARGES OR INTEREST OF ANY KIND. (original bill allowed for additional interest).
· There are specific disclosure requirements concerning fees, charges, penalties that were not in the original bill.

CS added a Home Inspector provision in addition to the board's sunset clause.Amended to raise surety fund to $10,000 from $20,000. Amended to extend the real estate commission and fixes some problems with the Home Inspector regulations

HB 468 imposes a $25 million limit on the supersedes bond MSA signatories, successors, and affiliates must post to stay the execution of a judgment in Alaska. Was amended to raise the bond from 25 to 100 million dollars and clarifies that the bill only applies to tobacco related civil litigation.

House Bill 515 changes existing law by adding lines 5 thru 8 on Page 2. This language states that a water or sewer utility owned by a political subdivision not directly competing with another water or sewer utility is exempt from RCA regulation.

House Bill 529 amends the procurement code so that the Department of Transportation and Public Facilities (ADOT/PF) can work directly with the Alaska Railroad Corporation (ARRC) on track work through a reimbursable service agreement similar to other utilities (i.e. power and water lines).

The current system, which allows little or no input from industry participants, must be changed to avert future crises in the industry. HB 540 provides not only for this needed input, but will raise the awareness of the actual system costs and will help all stakeholders monitor the equity in this critical Alaskan system. HB 542 lowers the limit of a project cost from $10,000 to $5,000, and expands the work that can be done by a specialty contractor. Current law allows unlicensed persons to act as contractors, when they are not. In fact, they compete with contractors and are not required to have a bond or insurance. Having no bond or insurance gives the consumer no protection from faulty work.. HB 542 remedies this problem.
