(JUNEAU) - In response to a recent U.S. Supreme Court decision, Representative Jim Holm (R- Fairbanks) has submitted legislation that would restrict the use of state and municipal powers of eminent domain.
"I don't believe that the government should be able to take away land from one private entity and assign title of that property to another private party under the pretense of 'economic development'," said Representative Holm.
Representative Holm's proposed legislation, HB 337, would disallow the state or municipalities from exercising its powers of eminent domain to acquire land for the purpose of increasing property tax income, creating jobs, or expanding economic development projects, including title transfers to other private parties.
Representative Holm concluded, "It is not right that an individual can be deprived of their home or investment property in order to satisfy the government's perception of an economic opportunity.
