The Task Force developed 13 pieces of draft legislation for the legislature's consideration as well as a host of continuing issues for further deliberation. For too long properly permitted projects end up being delayed before ground is ever broken. These projects are on hold because our current system allows individuals or entities to stop a project without a truly legitimate reason and without any serious consequences. Adding this section to the Special Actions and Proceedings of Civil Procedure language means that those who wish to stop projects will have to consider the economic effects of their actions. The bill is specifically written to give the courts latitude when determining damages because of improper action by a plaintiff. |

This provision allowed fishermen to obtain secured loans for Internal Revenue Service (IRS) debt retirement and was widely used during the time it was in effect. The long-term crisis facing the Alaska salmon industry due to dramatic increases in world salmon production, coupled with the equally dramatic reductions in salmon prices, makes this provision all the more important. If Alaska fishermen are forced out of the water because creditors take their limited entry fishing privileges, everyone in Alaska loses. |

The bill prohibits an employer of a commercial vehicle from knowingly allowing, authorizing, or encouraging the driver to violate any federal, state, or municipal code or regulation relating to highway railroad crossings. HB 124 also requires the court to disqualify a commercial motor vehicle driver for certain periods of time upon conviction of such violations.
