It will shield the public from vicarious liability inherent in our current law and protects small brokers in small communities. This bill is fully endorsed by the real estate community. Amended to allow an exemption for entities that 1) are businesses, 2) worth over $2 mil, AND 3) the business requests the exemption. Also, government agencies and corporations that issue publicly traded securities are exempt. The purpose of SSHB 29 is to protect consumers who are unsophisticated when it comes to buying real estate. The entities exempted by this amendment are not unsophisticated when it comes to real estate transactions, and therefore should be allowed an exemption. HB 31 also requires the total number of signatures in each district to amount to at least seven-percent of the total number of votes cast in that district in the most recent election. The total number of signatures required will remain at ten percent of the votes cast in the most recent election. HB 31 is a constitutional amendment and therefore will face a vote of the people.
